A CHARTER ORDINANCE EXEMPTING THE CITY OF PALCO, KANSAS, FROM SECTION 79-1953 OF THE GENERAL STATUTES SUPPLEMENT OF 1961, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT, AUTHORIZING AND LIMITING TAX LEVIES IN ANY ONE YEAR ON EACH DOLLAR OF ASSESSED VALUATION AND PRESCRIBING AN AGGREGATE FOR ALL CITY-WIDE TAX LEVIES.

Section 1. The City of Palco, Kansas, a city of the third class by the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to exempt and exempts itself from, and make inapplicable to it Section 79-1953 of the general statutes supplement of 1961 which is not applicable uniformly to all cities of the third class and the legislature not having established classes of cities for the purpose of imposing tax limitations and prohibitions, and provides substitute and additional provisions as hereinafter provided.

Section 2. The governing body of the City of Palco, Kansas is hereby authorized and empowered to levy taxes in each year for the following city purposes but said governing body shall not fix a rate of levy in any one year on each dollar of assessed tangible valuation of the city in excess of the following rates:

General operating fund (which shall include the following activities):

General government; police department; fire department; health and sanitation, including refuse collection and disposal; highways (all public-traveled ways, including bridges); sewer maintenance; sewage treatment and disposal; parks, cemeteries; street lighting; restroom; hydrant rentals; forestry; military memorial and maintenance; civil defense-10.00 mills

Provided, that any revenue derived from the’ motor vehicle and motor fuel taxes shall be budgeted to the credit of the highways department of said general operating fund and shall be used exclusively for the purposes for which received.

Library-2.00 mills.

       Provided, that the first one mill of said levy shall be outside the aggregate tax levy limit prescribed by this section.

Special lighting fund-1.00 mill.

Special lighting fund: If the city comes under the provisions of section 15-722 of the general statues of 1949 and amendments thereto-2.00 mills.

Special lighting fund: If the city comes under the provisions of Section 14-535 of the general statutes of 1949 and amendments thereto-1.00 mill;

Airport: Acquisition and maintenance-0.25 mill.

Band: As provided by Section 12-14a02 of the general statues of 1949 and amendments thereto:

Without an election as provided-0.50 mill. With an election as provided-1.00 mill.

Community building, repairing and maintaining-0.25 mill.
