A CHARTER ORDINANCE EXEMPTING THE CITY OF PALCO, KANSAS, FROM THE PROVISIONS OF K.S.A. 12-1222, AND ALLOWING THE CITY COUNCIL TO ESTABLISH A FIVE MEMBER LIBRARY BOARD.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF PALCO, KANSAS:

Section 1. The City of Palco, Kansas, by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas hereby elects to and does exempt itself and make inapplicable to K.S.A. 12-1222 which applies to this city but does not apply uniformly to all cities.

Section 2. The City of Palco, Kansas finds it difficult to recruit and approve library trustees for the Palco Public Library, the city uses the power of home rule, Kansas Statutes Annotated, Article 12, § 5(b), which empowers cities to determine local affairs and government, to proclaim that the library board shall consist of a minimum of five (5), but can have up to seven (7) trustees, including the mayor, who by virtue of their position is a library board trustee with all voting rights and privileges.
